XOOBAY Global Platform Terms of Service

I. General Provisions

1. These Terms of Service (hereinafter referred to as "Terms") are established by XOOBAY Global (hereinafter referred to as "we" or "Platform") and apply to all users (hereinafter referred to as "you") who access, use or participate in the XOOBAY Global platform (hereinafter referred to as "Platform").

2. Please carefully read and understand these Terms before using the Platform. If you do not agree to these Terms, please do not use the Platform.

3. Once you use the Platform, you agree to be bound by these Terms.

II. Platform Services

1. The Platform provides cross-border e-commerce platform services, including but not limited to:

    * Utilizing blockchain technology and artificial intelligence to enhance product sales and user experience.

    * Providing platform transaction, payment, logistics and other related services.

2. The Platform reserves the right to adjust or change platform services at any time without prior notice.

III. User Eligibility

1. Any individual or entity (manufacturer, supplier, etc.) may apply to become a registered user of XOOBAY Global.

2. Users must be at least 18 years old or of legal age and have full civil capacity.

3. Users must provide true, complete and accurate personal or company information and are responsible for the authenticity of the information provided.

4. Users must comply with all rules and policies of the Platform and are responsible for their own actions.

IV. User Obligations 

1. You promise to comply with relevant laws and regulations and these Terms when using the Platform.

2. You promise to provide true, accurate, complete and up-to-date personal information and update relevant information in a timely manner.

3. You promise not to engage in any conduct that violates laws and regulations, social morality or these Terms, including but not limited to:

    * Posting false information, prohibited goods or service information.

    * Infringing on the intellectual property rights or other legitimate rights and interests of others.

    * Engaging in fraud, scams or other illegal activities.

    * Damaging the normal operation of the Platform or the interests of others.

    * Using any automated program or script to access the Platform or collect information.

    * Interfering with or disrupting the Platform's security system or other users' use.

4. You are fully responsible for any losses caused by your violation of these Terms.

V. Product Listing and Sales

1. Users can list their products and sell them on their own.

2. Product information should be true, legal, and should not contain illegal or false content.

3. Users should ensure the quality and safety of their products and are fully responsible for their products.

4. Users must comply with the Platform's product listing guidelines and are responsible for the truthfulness, accuracy and completeness of the product information content.

5. The Platform reserves the right to review and delete any illegal product information.

6. Users must comply with the Platform's pricing rules and may not engage in malicious bidding or price fraud.

VI. Transactions and Payment

1. The transaction price, shipping method, etc. between users shall be determined by the buyer and seller through mutual negotiation.

2. The Platform provides a variety of secure and reliable online payment methods for users to choose from.

3. The Platform does not participate in specific transactions and only provides technical support and a trading environment.

4. Users must comply with the Platform's transaction process and are responsible for their actions during the transaction process.

5. Users must complete payment on time and are responsible for the payment of the transaction amount.

VII. Intellectual Property

1. The product information and related intellectual property rights published by users belong to the users themselves.

2. Users may not infringe on the intellectual property rights of others.

3. Users must ensure that the product information they publish does not infringe on any third-party intellectual property rights and are fully responsible for any infringement.

VIII. Platform Service Fees

1. Users need to pay a certain service fee when listing products and completing transactions on the Platform.

2. The service fee standard will be adjusted in a timely manner according to the actual situation and will be announced in advance.

3. Users must pay service fees according to the Platform's regulations and are responsible for the payment of service fees.

IX. Privacy and Security

1. The Platform will strictly protect user privacy information and will not disclose it to the outside world without the user's permission.

2. Users are responsible for taking necessary network security protection measures and are responsible for their own information security.

3. The Platform will take reasonable measures to protect user information security, but the Platform is not responsible for information leaks caused by the user's own reasons.

Information collection and usage:
- The platform only collects necessary personal information from users during registration and use of platform services, such as name, email, phone number, etc.
- The collected information is only used for providing platform services, improving user experience, conducting data analysis, and marketing purposes.
- User personal information will not be sold or rented to third parties.
Information security:
- Use encryption technology to protect the security of data transmission and storage.
- Regularly conduct security vulnerability scans and fixes, take measures to prevent malicious attacks and data leaks.

X. Dispute Resolution

XI. Disclaimer

1. The Platform only provides Platform services and does not assume any responsibility for any losses incurred by you during the use of the Platform.

2. The Platform does not guarantee that the Platform services will be free from errors or interruptions, nor does it guarantee that the Platform services will meet your specific needs.

3. The Platform is not responsible for any indirect losses, special losses, punitive damages or consequential damages arising from your use of the Platform services.

4. The Platform is not responsible for service interruptions or failures caused by force majeure or other factors beyond the Platform's control.

XII. Applicable Law and Jurisdiction

1. These Terms are governed by and construed in accordance with the Basic laws of HKSAR.

2. The interpretation of these Terms belongs to the Platform.

XIII. Others

1. If any part of these Terms is invalid or unenforceable, it shall not affect the validity of the remaining parts.

2. The Platform reserves the right to modify these Terms at any time, and the modified Terms shall take effect upon publication on the Platform.
